This letter constitutes the formal agreement (“Contract”) between Alibi Music, LP (“Alibi”) and you (herein described as the Session Artist), whereby you are being hired for compensation to play/perform on the above titled recording(s) whereby you agree to provide your professional services as a musician or vocalist for the purposes of making studio recordings (“Recordings”), as hereinafter set forth.
Terms and Conditions
- Compensation: Upon immediate completion of the contracted Recording Session date(s) above, you will be paid the amount of $00 for your services.
- Waiver of royalties and rights: By entering into this contract and agreeing to the above compensation amount, you agree that this is a work for hire agreement and that you will have no rights to any Royalties earned by this project’s recordings. In accordance with the foregoing, Alibi shall be considered the sole author and, at all stages of completion, the sole and exclusive owner of the Recordings and all right, title and interest therein (“Rights”). The Rights shall include, without limitation, all copyrights and any and all other ownership and exploitation rights in the recordings now or hereafter recognized in any and all territories and jurisdictions. If, under any applicable law, the fact that the Recordings is a work made for hire is not effective to place authorship and ownership of the Recordings and all rights therein in Alibi, then, to the fullest extent allowable and for the full term of protection otherwise accorded to you under such applicable law, you hereby assigns and transfers to Alibi the Rights in connection therewith, and any and all right, title and interest in such Recordings and any other works now or hereafter created containing the Recordings in perpetuity. Alibi shall have in its sole discretion the right to remaster, edit, modify, and/or publish the Recordings into multiple formats, including but not limited to various durations or sub-tracks. For clarity‘s sake, any such edits, modifications, and/or sub-tracks of the same Recordings shall be considered and referred to collectively as a Recording for the purposes of this Agreement.
- Non-use of material: By accepting the above compensation amount, you agree not to use any of the songs recorded at the stated session without the expressed written consent of Alibi Music, LP. To this extent you are granting Alibi Music, LP the exclusive right of your performance during these sessions.
- Copyright: Alibi Music, LP will secure the copyright(s) to all songs recorded during the above dates and all recorded songs shall be the sole property of Alibi Music, LP.
I AGREE THAT AS A SESSION MUSICIAN/VOCALIST, I HAVE NO CLAIMS WHATSOEVER TO ANY PART OF THE RECORDINGS STATED IN THIS AGREEMENT.
This agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania governing contracts wholly executed and performed therein and to the laws of the United States of America.
